Article 1 General
1.1 Fine Forest is a trade name of Studio Mooijman en Mittelberg, registered in the Trade Register under code 564.899.35 and has its registered office in The Hague.
1.2 These general terms and conditions apply to all offers, orders and agreements of Fine Forest.
1.3 By placing an order you indicate that you agree with the delivery and payment conditions. Fine Forest reserves the right to change its delivery and / or payment conditions after the expiry of the term.
1.4 The provisions of these general terms and conditions may only be deviated from if this has been expressly agreed in writing and in which case the other provisions of these general terms and conditions remain in full force.
Article 2 Delivery and returns
2.1 Delivery takes place while stocks last.
2.2 Delivery will take place within 2 to 7 working days. Unless stated otherwise on the website. If the delivery time will not be met within 7 working days, the customer will receive an email from Fine Forest stating the correct delivery time. In that case, the customer has the authority to dissolve the agreement with Fine Forest by notifying Fine Forest in writing (by letter or e-mail). Fine Forest will agree on a delivery period of a maximum of 30 days.
2.3 All terms and conditions stated on the website are indicative. No rights can therefore be derived from the aforementioned periods.
2.4. Any payments already made by the customer will be refunded to the customer’s bank or giro account as soon as possible, but in any case within fourteen working days after Fine Forest has received the request to terminate the agreement referred to in the previous article (article 2.2).
2.5. After the customer has received the article ordered by him/her, the customer has the right to dissolve the underlying agreement with Fine Forest within fourteen (14) days after receipt of this article. The customer does not have to give a reason for this.
2.6. If the customer wishes to dissolve the agreement in accordance with article 2.5 of these general terms and conditions, the customer must return the article in the correct and intact packaging, after consultation with Fine Forest, to an address determined by Fine Forest. In this case, the customer must bear the costs and risk of shipping himself.
2.7. If the customer has already made any payments at the time, Fine Forest will make these payments within fourteen (14) working days after Fine Forest has received the article returned by the customer. If the total order amount, after processing the return shipment, is below € 60 (for the Netherlands), the right to free shipping will lapse. In this case Fine Forest will deduct the shipping costs from the amount to be credited.
2.8. Fine Forest reserves the right to refuse returned items or to credit only part of the amount already paid, if it is suspected that the item has already been opened, used or through the fault of the customer (other than that of Fine Forest or the supplier of the item) is damaged.
2.9. If an article is returned that, in the opinion of Fine Forest, has suffered damage that can be attributed to an act or default of the customer or is otherwise at the risk of the customer, Fine Forest will inform the customer in writing (via letter or e-mail ) letting someone know. Fine Forest has the right to deduct the depreciation of the item as a result of this damage from the amount to be refunded to the customer.
2.10 If free products are provided for promotions above a certain order amount, the following applies: When the total order amount, after processing the return shipment, falls below the set order amount whereby a free product was provided, Fine Forest will charge the webshop value of the free product.
2.11 If a customer receives an ordered product that is damaged, this must be communicated by e-mail within 48 hours of receipt. Only fully submitted claims can be handled by Fine Forest. For the correct handling of claims, the customer must provide Fine Forest with the following evidence:
- Some clear photos of the damaged product
- A photo of the shipping packaging
- A (number of) photo (s) of the used protection material and filling material
- An order number
- A photo of the product, with the used protective material and padding material in the shipping packaging, clearly showing that the product has been carefully packed by us.
Article 3 Payment and shipping
3.1. All prices mentioned on the website are in euros and include legally established sales tax (VAT).
3.2 Prices will not be increased within the term of the offer, unless legal measures make this necessary or if the manufacturer makes interim price increases.
3.3 All prices on the website are subject to printing and typing errors. No liability is accepted for the consequences of printing and typesetting errors.
3.4 Orders are only shipped after they have been paid in advance. Payment is possible via iDeal, Giropay, ING Home’Pay, Bancontact and SOFORT Banking.
3.5 For shipping within the Netherlands, Fine Forest charges € 3.95 shipping costs for Extra Small, Small and Medium stickers and € 6.95 shipping costs for Extra Large stickers. With an order amount above € 60, the shipping costs within the Netherlands will be free of charge. For international shipping applies:
- Belgium / Germany / Denmark / France / Luxembourg / Monaco / Austria / Italy / Sweden / Spain: Letterbox post € 6.00 – Parcel post € 9.80
- Slovakia / Czech Republic / Hungary / Poland / Slovenia / Ireland / Portugal / Finland / Romania / Bulgaria / Estonia / Latvia / Lithuania / Greece: Letterbox post € 6.00 – Parcel post € 12.60
3.6 For orders that can be sent as so-called letter post, adjusted shipping costs are charged.
3.7 After receipt of the payment, an order will be shipped between 2 and 7 working days. An exception to this is a possible holiday, this will be stated on the website.
3.8 All orders are shipped via PostNL (without track & trace code).
3.9 If the buyer is not in the country of dispatch, the buyer is liable for any applicable sales tax or import duties.
Article 4 Privacy
4.1 If you place an order with Fine Forest, your data will be included in the Fine Forest customer base. Fine Forest adheres to the Data Protection Act and will not provide your information to third parties, unless it concerns the processing of your order (see 4.4).
4.2 Fine Forest respects the privacy of the users of the website and ensures confidentiality of your personal information.
4.3 Fine Forest uses a mailing list. Each mailing contains instructions on how to remove yourself from this list.
4.4. Personal data entered by the customer will be included in a file. This information will only be used for the execution of the customer’s order (our contact with the customer and the shipment of your order). Your address details will then be passed on to PostNL or another sender. Personal data will not be passed on to third parties.
4.5. Unless the customer has indicated an objection, the customer’s data will be included in a central file of Fine Forest. This data will be used to keep the customer fully up-to-date with regard to Fine Forest’s business and services. The processing of the customer’s data will take place in accordance with applicable laws and regulations.
4.6. If desired, the customer can inspect the data that Fine Forest records about the customer in Fine Forest’s file. The customer is entitled to request changes to the data if this information is incorrect.
Article 5 Guarantees
5.1 Fine Forest guarantees that the delivered items comply with the agreement and meet the specifications stated in the offer, and thus guarantees the manufacturer’s warranty of the item delivered to you.
5.2 Fine Forest’s warranty period corresponds to the manufacturer’s warranty period. This warranty does not apply if the defect is due to 1. neglected care, or 2. deliberate damage, or 3. inattention, or 4. incorrect confirmation.
5.3 Fine Forest does not provide any guarantee on surfaces or other contact surfaces to which and / or on which the delivered product is glued.
Article 6 Offers
6.1. Quotations are without obligation, unless stated otherwise in the quotation.
6.2 Upon acceptance of a non-binding offer by the customer, Fine Forest reserves the right to revoke or deviate from the offer within 3 working days of receipt of that acceptance.
6.3 Oral commitments are only binding on Fine Forest after they have been explicitly confirmed in writing.
Article 7 Agreement
7.1. An agreement between Fine Forest and a customer is concluded after an order or assignment has been assessed by Fine Forest for feasibility.
7.2 Fine Forest reserves the right not to accept orders or assignments without stating reasons or to accept them only on the condition that the shipment is made after payment in advance.
Article 8 Images and specifications
8.1 All images; photos, drawings, etc. and (technical) specifications; including information on weights, dimensions, colors, etc. on the Fine Forest website are only approximate, are indicative and cannot give rise to compensation or termination of the agreement.
Article 9 Force majeure
9.1. Fine Forest is not liable if and insofar as its obligations cannot be fulfilled as a result of force majeure.
9.2. Force majeure is understood to mean any strange cause, as well as any circumstance that should not reasonably be at its risk. Delays or non-performance by our suppliers, transport difficulties, strikes, government measures, delays in supply, negligence of suppliers and / or manufacturers of Fine Forest. Auxiliary persons, illness of personnel, defects in auxiliary or transport equipment are expressly considered force majeure.
9.3. In the event of force majeure, Fine Forest reserves the right to suspend its obligations and is also entitled to dissolve the agreement in whole or in part, or to demand that the content of the agreement be amended in such a way that execution remains possible. Under no circumstances is Fine Forest obliged to pay any fine or compensation.
Article 10 Communication
10.1 Fine Forest is in no way liable for misunderstandings, damage, delays or unclear transmission of orders and communications as a result of the use of the internet or any other means of communication in the traffic between the customer and Fine Forest, or between Fine Forest and third parties, insofar as they relate to the relationship between the customer and Fine Forest.
Article 11 Complaints
11.1. All complaints related to the delivery, quality, quality of the article or any other complaint will be taken seriously by Fine Forest.
11.2. The customer must make a complaint known in writing to Fine Forest (letter or e-mail).
11.3. Fine Forest will try to resolve the complaint within seven (7) working days. Fine Forest will inform the customer about this in writing (by letter or e-mail).
Article 12 Intellectual and industrial property rights
12.1. The customer must fully and unconditionally respect all intellectual and industrial property rights that rest on the goods delivered by Fine Forest.
12.2. Fine Forest does not guarantee that the goods delivered to the customer do not infringe any intellectual and / or industrial property right of third parties and does not accept any liability in the event of any claim from third parties based on the statement that a good delivered by Fine Forest is infringed. made on any right of a third party.
Article 13 Miscellaneous
13.1 If the customer provides Fine Forest with an address, Fine Forest is entitled to send all orders to the relevant address, until the customer has given Fine Forest a new address.
13.2. Fine Forest is authorized to make use of third parties in the execution of the customer’s order(s).
Article 14 Applicable law and dispute settlement
14.1. Dutch law applies to all offers, orders and agreements of Fine Forest.
14.2 Disputes arising from an agreement between Fine Forest and the customer, which cannot be resolved by mutual agreement, will be submitted exclusively to the competent court.
Article 15 Placement and removal of the wall sticker
15.1. Fine Forest cannot be held liable in any way for possible damage to a wall or other surface after, during or as a result of the application or removal of a Fine Forest product. This also applies to any discoloration of a wall or wall.
15.2. Fine Forest cannot be held liable in any way for the stickers not sticking to walls with (structured) wallpaper, fine sanding, spachtelputz or other stucco with a structure or grains.
15.3. Fine Forest is not liable for the life of the wall sticker. The lifespan of a sticker depends entirely on the surface, humidity and temperature in the room, placement in (sun) light, frequency of cleaning and specific characteristics of rooms (such as a room in which smoking is carried out).
15.4. Fine Forest cannot guarantee that the stickers will stick properly outside the communicated retention period of two months. The adhesive strength will decrease after this period.
